Welcome to BookMyCare (“we,” “our,” or “us”). These Terms & Conditions (“Terms”) govern your access to and use of the BookMyCare mobile application, website, and related services (collectively, the “Platform”). By accessing or using our Platform, you acknowledge that you have read, understood, and agreed to be bound by these Terms. If you do not agree to these Terms, you must not use the Platform.

1. About BookMyCare

BookMyCare is a technology-driven platform that acts solely as a facilitator enabling users (“Users” or “you”) to book appointments with independent third-party service providers (“Vendors”) who offer personal care, beauty, wellness, health, and related services.

BookMyCare does not provide any services itself, nor does it own, control, or manage any Vendor’s services, facilities, or staff. We are not responsible for the quality, safety, legality, or conduct of any Vendor or their services. We do not supervise or endorse any Vendor, and we provide no warranties or guarantees regarding the services booked through our Platform.

 

2. User Eligibility and Account Registration

• To use the Platform, you must be at least 18 years old or have consent from a parent or legal guardian if you are a minor.

• You must have the legal capacity to enter into binding contracts and to comply with these Terms.

• You agree to provide true, accurate, current, and complete information when registering an account and during any booking process.

• You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

• You must notify us immediately of any unauthorized use or security breach related to your account.

 

3. Booking Process and Appointment Management

• Users can browse Vendor profiles, services, prices, available time slots, and other details on the Platform to make an appointment booking request.

• Bookings are subject to confirmation by the Vendor, either manually or automatically, as displayed on the Platform. Until confirmed, a booking is not final.

• BookMyCare does not guarantee appointment availability or booking confirmation and is not responsible for any delays or cancellations by Vendors.

• Changes to bookings, cancellations, or rescheduling must be coordinated directly between the User and the Vendor in accordance with the Vendor’s policies.

• BookMyCare is not responsible for any consequences arising from missed appointments or changes made by Vendors or Users.

 

4. Payments and Fees

• BookMyCare may charge Users a nominal booking fee or convenience fee for using the Platform, which will be clearly disclosed before payment.

• The full payment for any service booked through the Platform is made directly to the Vendor, either through the Platform’s integrated payment system or at the Vendor’s physical location, depending on Vendor terms.

• All online payments are processed securely via authorized third-party payment gateways (e.g., Razorpay). BookMyCare does not store, access, or handle any of your payment credentials.

• Refunds for service cancellations, disputes, or dissatisfaction are subject solely to the Vendor’s refund and cancellation policies. BookMyCare is not liable or responsible for refund processing or disputes.

• Any tax liabilities, fees, or charges associated with the services or payments are the responsibility of the User or Vendor as applicable.

 

5. BookMyCare’s Role and Disclaimer of Liability

• BookMyCare strictly acts as an intermediary technology platform for appointment booking only. We do not provide, guarantee, or endorse any services listed on our Platform.

• We do not supervise, monitor, or control the conduct, qualifications, or licensing of Vendors or the quality, safety, or legality of their services.

• You acknowledge and agree that BookMyCare is not responsible or liable for:

  • The accuracy or completeness of Vendor information, including service descriptions, prices, availability, or ratings.

  • Any acts, omissions, negligence, errors, or malpractice by Vendors.

  • Any personal injury, property damage, financial loss, or other harm arising from or related to the use of Vendor services.

  • Any disputes, disagreements, or legal issues between Users and Vendors.

• Users are solely responsible for assessing the suitability and safety of Vendors and their services before booking.

• By using the Platform, you agree to hold BookMyCare harmless from any claims or damages resulting from your use of Vendor services.

 

6. User Obligations and Code of Conduct

You agree to:

• Use the Platform lawfully and in compliance with all applicable laws, rules, and regulations.

• Provide accurate, honest, and complete information in all interactions with BookMyCare and Vendors.

• Not use the Platform to engage in fraudulent, abusive, defamatory, or harmful activities.

• Respect the rights, privacy, and safety of other Users and Vendors.

• Not interfere with or disrupt the Platform’s operations, security, or systems.

• Report any misuse, suspicious activity, or violations to BookMyCare promptly.

BookMyCare reserves the right to suspend or terminate your account or access to the Platform for violations of these Terms or harmful conduct.

 

7. Intellectual Property Rights

• All content, trademarks, logos, software, graphics, and materials on the BookMyCare Platform are owned by BookMyCare or its licensors and are protected by intellectual property laws.

• You may not copy, reproduce, distribute, modify, create derivative works from, or publicly display any content from the Platform without prior written consent from BookMyCare.

• BookMyCare grants you a limited, non-exclusive, non-transferable license to use the Platform for personal and lawful appointment booking purposes.

 

8. Limitation of Liability and Disclaimer of Warranties

To the fullest extent permitted by law:

• BookMyCare provides the Platform “as is” and “as available” without warranties of any kind, whether express or implied.

• We do not warrant that the Platform will be uninterrupted, error-free, or free from viruses or harmful components.

• BookMyCare expressly disclaims all warranties, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.

• Under no circumstances shall BookMyCare, its affiliates, employees, or agents be liable for any indirect, incidental, consequential, punitive, or special damages arising from your use of or inability to use the Platform or any Vendor services, even if advised of the possibility of such damages.

• Your sole remedy for dissatisfaction with the Platform or Vendor services is to discontinue use.

 

9. Indemnification

You agree to indemnify, defend, and hold harmless BookMyCare, its affiliates, officers, directors, employees, and agents from and against any and all claims, demands, losses, liabilities, damages, costs, or expenses (including legal fees) arising out of or related to:

• Your violation of these Terms.

• Your misuse of the Platform or interaction with Vendors.

• Any breach of your representations, warranties, or obligations under these Terms.

 

10. Termination and Suspension

BookMyCare reserves the right, at its sole discretion, to suspend, restrict, or terminate your access to the Platform and related services without prior notice, for reasons including but not limited to:

• Violation of these Terms.

• Illegal or unauthorized use of the Platform.

• Harmful, abusive, or disruptive conduct.

• Security threats or fraud concerns.

Termination does not relieve you of any payment obligations or liabilities incurred before termination.

 

11. Changes to Terms & Conditions

We may update or revise these Terms from time to time to reflect changes in our practices, legal requirements, or Platform features.

• Updated Terms will be posted on the Platform with a revised effective date.

• Your continued use of the Platform after such changes constitutes your acceptance of the updated Terms.

• It is your responsibility to review these Terms periodically.

 

12. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Republic of India.

All disputes arising out of or related to these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of courts located in Ahmedabad, Gujarat, India.

 

13. Privacy and Data Protection

Your use of the Platform is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. Please review our Privacy Policy carefully.

All service-related issues, including quality, refunds, cancellations, or disputes, are matters exclusively between the User and the Vendor.
