A LEGAL DISCLAIMER

These Terms & Conditions ("Terms") are a binding agreement between you and [TECHIKE SOLUTIONS LLP] ("BookMyCare", "we", "us", "our") governing your use of the BookMyCare website, mobile apps, Clinic Portal, Provider Portal, APIs, and related services (collectively, the "Services").
These Terms constitute an "electronic record" under the Information Technology Act, 2000 and the rules made thereunder. They do not require a physical signature.
PLEASE READ CAREFULLY. IF YOU DO NOT AGREE, DO NOT USE THE SERVICES.
1. Who Can Use the Services
You must be at least 18 years old and competent to contract under the Indian Contract Act, 1872. If you are booking on behalf of a minor or dependant, you confirm that you are their parent/legal guardian and consent on their behalf.
2. Nature of Services — Important Disclaimer
BookMyCare is a technology platform that helps patients discover hospitals, clinics, doctors, and diagnostic labs ("Providers"), book appointments, manage queues and walk‑ins, receive prescriptions and lab reports, and make related payments.
We are not a medical practitioner, hospital, clinic, pharmacy, or laboratory.
We do not provide medical advice, diagnosis, or treatment.
All clinical decisions are made solely by the Provider. The Provider is independently responsible for the quality, timing, and outcome of care.
Listings, profiles, timings, fees, ratings and availability are provided by Providers or aggregated from public sources and may change without notice.
In case of a medical emergency, call 112 or your local emergency number — do not use BookMyCare.
3. Your Account
You must provide accurate, current and complete information.
You are responsible for activities under your account and for safeguarding your credentials and OTPs.
Notify us immediately at [security@bookmycare.com] of any unauthorised use.
We may refuse, suspend or terminate accounts that violate these Terms, applicable law, or Provider requirements.
4. Bookings, Walk‑ins, Queues, and Slot Locks
When you book an appointment, we attempt to reserve (lock) a slot with the Provider. A slot lock is not a confirmation until the Provider accepts or the system returns a confirmation.
The Provider may modify, reschedule or cancel slots due to clinical reasons, emergencies, or unavailability.
For walk‑ins and queue‑based visits, wait times are estimates only and depend on the Provider.
You agree to follow the Provider's on‑site rules, identity verification, and COVID/safety protocols where applicable.
"Doctor Ready" / ready‑status features indicate the Provider's operational status, not a guarantee of immediate consultation.
5. Cancellations, No‑shows, Rescheduling & Charge Policy
Each Provider sets its own appointment charge policy, including consultation fees, cancellation fees, no‑show fees, refund window, and rescheduling rules. These are shown at the time of booking.
Where a Provider enforces a no‑show or late‑cancellation fee, you authorise BookMyCare to collect it through the payment method on file, in accordance with the policy you accepted at booking.
The future‑booking window (how far in advance you can book) is set per Provider and may change.
Refunds, where due, are processed back to the original payment method and typically reach you within 5–10 business days, subject to your bank/PSP.
6. Prescriptions, Lab Tests & Medical Records
Prescriptions and lab reports are created and signed by the Provider. BookMyCare only stores and delivers them.
Reference numbers ("prescription ref") are for tracking only and do not replace a valid prescription.
Do not self‑medicate based on past prescriptions. Consult a qualified doctor.
You are responsible for ensuring the medical information you provide (intake forms, symptoms, allergies) is accurate.
7. Payments, Fees & Taxes
Fees displayed include or exclude GST as indicated. You are liable for applicable taxes.
Payments are processed by third‑party payment aggregators. By paying, you agree to their terms.
In case of a failed transaction where money is debited, we will reconcile with the payment aggregator; refunds typically occur within 5–10 business days.
We may charge convenience, platform, or booking fees; these will be disclosed before payment.
Chargebacks filed without first contacting support may result in suspension.
8. Reviews & User Content
You may submit ratings, reviews, photos and comments ("User Content") about Providers.
You must submit only honest, first‑hand experiences. No defamatory, unlawful, obscene, hateful, misleading, or promotional content.
Do not upload another person's medical data, identifiable images, or confidential information without consent.
You grant BookMyCare a worldwide, royalty‑free, sublicensable, perpetual licence to host, store, display, reproduce, translate, and distribute your User Content in connection with the Services.
We may moderate, edit, reject, or remove User Content at our discretion, but we have no general obligation to monitor.
9. Acceptable Use
You agree not to:
Use the Services for any unlawful purpose or in breach of any applicable law (including the IT Act, 2000, Drugs & Cosmetics Act, Clinical Establishments Act, consumer and data‑protection law).
Impersonate any person, misrepresent your identity, or use another person's account.
Upload viruses, malware, or any code that disrupts the Services.
Attempt to gain unauthorised access, reverse engineer, decompile, scrape, or probe the Services (except as expressly permitted by law).
Use the Services to harass, threaten, stalk, or harm any Provider, patient, or staff.
Resell, redistribute, or build a competing service using our data.
Circumvent rate limits, security features, or access controls.
Post content prohibited under Rule 3 of the IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.
Violations may lead to immediate suspension, termination, and legal action.
10. Provider Terms (applies to hospitals, clinics, doctors, labs, admins)
If you use the Provider Portal or Clinic Portal:
You warrant that you are duly qualified, registered, and licensed under all applicable medical, pharmacy, or diagnostic laws, and that your registrations are current.
You are solely responsible for the accuracy of profiles, fees, schedules, services offered, and any clinical advice or prescription you issue.
You agree to comply with the Clinical Establishments Act, NMC/Dental/Nursing Council regulations, the IT Act, DPDP Act, and the Drugs & Cosmetics Act.
You appoint BookMyCare as your limited agent to collect bookings and (where applicable) fees on your behalf.
You agree to respect patient privacy, obtain necessary consents, and not to misuse patient data accessed through the Services.
You indemnify BookMyCare for any claim arising from your acts, omissions, negligence, or regulatory violations.
11. Intellectual Property
All content, software, designs, logos, trademarks, and data compilations on the Services (other than User Content and Provider‑supplied content) are owned by BookMyCare or its licensors and are protected by Indian and international IP laws. No licence is granted except as expressly stated. The name "BookMyCare", the logo, and related marks are trademarks of BookMyCare. You may not use them without prior written permission.
12. Third‑Party Services
The Services may include links, plug‑ins, or content from third parties (e.g., payment gateways, maps, WhatsApp, messaging providers). We are not responsible for those services, their content, or their privacy practices.
13. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON‑INFRINGEMENT, AND UNINTERRUPTED OR ERROR‑FREE OPERATION.
WE DO NOT WARRANT THE ACCURACY, COMPLETENESS OR RELIABILITY OF PROVIDER INFORMATION, WAIT TIMES, RATINGS, OR LAB RESULTS.
WE DO NOT WARRANT THAT THE SERVICES WILL MEET YOUR REQUIREMENTS OR BE AVAILABLE AT ALL TIMES.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
BOOKMYCARE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, OR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OPPORTUNITY, ARISING OUT OF OR RELATED TO THE SERVICES.
WE ARE NOT LIABLE FOR ANY ACT, OMISSION, MEDICAL ADVICE, TREATMENT, NEGLIGENCE, OR OUTCOME OF A PROVIDER.
OUR AGGREGATE LIABILITY FOR ALL CLAIMS IN A 12‑MONTH PERIOD WILL NOT EXCEED THE GREATER OF (a) THE FEES YOU PAID TO BOOKMYCARE IN THE PRECEDING 3 MONTHS, OR (b) INR 5,000.
Some jurisdictions do not allow certain limitations; in that case the above applies to the fullest extent permitted.
15. Indemnity
You agree to indemnify, defend, and hold harmless BookMyCare and its affiliates from any claim, damage, loss, liability, cost or expense (including reasonable legal fees) arising from (i) your breach of these Terms, (ii) your misuse of the Services, (iii) your User Content, (iv) your violation of law or third‑party rights, or (v) for Providers, any clinical act, omission, or regulatory violation.
16. Suspension & Termination
We may suspend or terminate your access, with or without notice, if we reasonably believe you have violated these Terms, applicable law, or Provider rules, or if required by a regulator. You may terminate your account at any time via in‑app settings or by writing to [support@bookmycare.com]. Sections that by their nature survive termination (IP, disclaimers, limitation of liability, indemnity, dispute resolution) will continue.
17. Force Majeure
We are not liable for delays or failures caused by events beyond our reasonable control, including acts of God, pandemics, war, strikes, network outages, power failure, governmental action, or failure of third‑party services.
18. Governing Law & Dispute Resolution
These Terms are governed by the laws of India, without regard to conflict‑of‑law rules. Subject to Section 19 below, the courts at [City, e.g., Bengaluru], Karnataka, India have exclusive jurisdiction.
19. Modifications to the Terms
We may update these Terms periodically. Material changes will be notified in‑app, by email or website notice at least 7 days before they take effect (or sooner if required by law). Continued use after the effective date constitutes acceptance.
20. Miscellaneous
Entire agreement: These Terms, together with the Privacy Policy and any Provider‑specific or product‑specific terms, form the entire agreement.
Severability: If any provision is held unenforceable, the rest remain in effect.
No waiver: A failure to enforce any right is not a waiver.
Assignment: You may not assign these Terms; we may assign to an affiliate or successor.
Notices: We may send notices in‑app, by email, or SMS to the contact information on file.
Language: These Terms are in English. Translations are for convenience only; the English version prevails.
